What is a Fiktionsbescheinigung?
A Fiktionsbescheinigung (fiction certificate) is a paper document from the Ausländerbehörde confirming that your residence status is provisionally continued or deemed issued while a decision on your application is pending. It is not a full electronic residence card (eAT / Aufenthaltstitel).
People often receive it when they applied for extension (Verlängerung) or a new permit before the old one expired, but the office has not yet issued the new card or Bescheid. It bridges the gap so you do not become undocumented overnight.
Legal basis — § 81 AufenthG
Section § 81 AufenthG (Residence Act) creates a legal fiction (Fiktion): the law treats your previous title as still valid, or treats a new title as already granted, even though the physical document does not yet exist.
The certificate states which subsection applies — this determines your rights. Always read the exact wording on your Fiktionsbescheinigung; do not assume it works like your old eAT in every situation.
Who issues it
Your local or regional Ausländerbehörde issues the Fiktionsbescheinigung, usually at an appointment or when you submit a complete extension application in time. It references your Aktenzeichen, passport number, and the underlying permit or application.
Some offices issue it automatically; others require you to ask explicitly when booking your Termin. Keep the original and make copies for your employer or landlord if needed.
Two types of Fiktion
- Fiktion des Fortbestehens (§ 81 Abs. 3 AufenthG) — your previous Aufenthaltstitel is treated as continuing under its old conditions until a decision is made
- Fiktion der Weiterergeltung (§ 81 Abs. 4 AufenthG) — a new title you applied for is treated as already in force (often after a positive decision but before the card is produced)
Fortbestehen typically applies during pending extension; Weiterergeltung often follows approval of a change of purpose or first grant. Work rights follow the fiction type and what your letter states — not what you expect from memory.
When you receive one
- You applied for Verlängerung before Gültig bis on your eAT and the office is still processing
- Your permit expired but a timely application was accepted — Fiktion may backdate protection if rules are met
- A new permit was approved but the eAT chip card is not ready yet
- You changed employer, purpose of stay, or permit category and the new title is pending
If you missed the deadline to apply, you may not get Fiktion — status can lapse immediately. Apply early and keep proof of submission (Eingangsbestätigung, appointment confirmation).
How to read your certificate
- Gültig bis — end date of the Fiktionsbescheinigung itself; you may need a new one if processing continues
- Art der Fiktion — Fortbestehen vs Weiterergeltung
- Erwerbstätigkeit — whether employment is allowed, restricted, or unchanged from prior title
- Passnummer / Staatsangehörigkeit — must match your passport exactly
- Bezug — reference to the underlying Aufenthaltstitel or application
Errors in name or passport number can cause problems at employers or borders. Ask for correction before travel or starting a new job.
Work rights and employment limits
Under Fiktion des Fortbestehens, work conditions usually stay the same as on your expiring title — e.g. employment with a named employer, Blue Card rules, or study limits. Under Weiterergeltung, conditions may reflect the newly approved permit.
Employers often ask for an eAT; show the Fiktionsbescheinigung plus passport and explain the pending decision. Working without permitted Erwerbstätigkeit can endanger your application and future extensions.

Travel, Schengen and re-entry
A Fiktionsbescheinigung is weaker for travel than a valid eAT. Re-entry to Germany from outside the Schengen area is not guaranteed — many carriers and border officials expect a full residence permit or visa.
- Schengen short trips — sometimes possible with Fiktion plus passport; check airline and destination rules
- Non-Schengen travel — often requires a Fiktionsbescheinigung mit Reisegenehmigung or return visa from the Ausländerbehörde; apply before leaving
- Expired passport — renew passport first; Fiktion is tied to valid identity documents
Never assume you can re-enter like with a normal Aufenthaltstitel. Get written travel clearance from the Ausländerbehörde if you must leave Germany while on Fiktion.
Extension and renewal of the Fiktion
The Fiktionsbescheinigung has its own Gültig bis, often three to six months. If the Ausländerbehörde still has not decided, you need a renewed Fiktionsbescheinigung before it expires — book another Termin early.
Bring updated documents: payslips, employment contract, Meldebescheinigung, insurance, rent contract, and any requests the office sent. Letting Fiktion lapse without a new certificate or final eAT can mean unlawful stay.
Fiktionsbescheinigung vs Aufenthaltstitel
- Aufenthaltstitel (eAT) — electronic card; primary proof of residence; generally better for employers, banks, and travel
- Fiktionsbescheinigung — temporary paper bridge under § 81 AufenthG; pending decision; limited travel; fixed expiry
- Visa sticker — entry document in passport; not a substitute for either
- Duldung — tolerated stay; different legal basis; not the same as Fiktion on a proper permit

Step 5: Respond quickly to Nachforderung (requests for more documents).
Step 6: Collect eAT as soon as the office notifies you — Fiktion ends when the card is issued.
When to get help
- Fiktion expires within days and no appointment is available
- You must travel for family emergency but have no Reisegenehmigung
- Ablehnungsbescheid arrives while you thought Fiktion protected you
- Employer or Ausländerbehörde disputes your work rights
- Letter is only in German and you need deadlines explained
