Aufenthaltstitel — residence permit decisions explained

Letters from the Ausländerbehörde grant, extend, or refuse your right to stay in Germany. They set how long you can remain, whether you may work, and what happens if you miss a deadline.

What is an Aufenthaltstitel?

An Aufenthaltstitel is your official residence permit under the Residence Act (AufenthG). It is usually issued as an electronic card (eAT — elektronischer Aufenthaltstitel) with a chip, plus a decision letter (Bescheid) from the Ausländerbehörde (immigration office).

The permit states your purpose of stay (work, study, family, protection), validity dates, and any conditions — especially Erwerbstätigkeit gestattet/beschäftigung verboten (whether employment is allowed).

Who sends it — Ausländerbehörde

Your local or regional Ausländerbehörde decides residence matters. Letters may reference your file number (Aktenzeichen), passport number, and the legal paragraph (e.g. §§ AufenthG).

Keep every letter and appointment confirmation. Many deadlines are strict — applying late can mean loss of legal status.

Check that passport name, date of birth, and nationality on the letter match your documents exactly.

Fiktionsbescheinigung — permit pending

If you applied for extension or a new title before your current one expired, you may get a Fiktionsbescheinigung. It states that your previous status is provisionally continued (Fiktion des Fortbestehens) or that a new title is deemed issued until a decision is made — read which type applies.

It is not a permanent solution. You still need appointments, may have restricted travel, and must not miss further requests for documents.

Extension — apply before expiry

Apply for Verlängerung early — often 4–8 weeks before Gültig bis, or as soon as the office allows online booking. Typical documents: passport, registration (Meldebescheinigung), employment contract or enrollment, payslips, rent contract, insurance, passport photos, fees.

If your permit expires before a decision, status depends on whether you applied in time and received Fiktion — get legal advice immediately if expired.

Work and job loss

Many permits tie stay to a specific job or purpose. If your employer terminates you, see Kündigung vom Arbeitgeber — but also notify the Ausländerbehörde quickly. You may have a short grace period to find new qualifying work; Blue Card and skilled worker rules differ.

Working without permission or for the wrong employer can endanger future extensions and lead to fines or removal.

Rejection — Ablehnungsbescheid

An Ablehnungsbescheid refuses your application and states reasons (missing requirements, insufficient income, wrong permit type). The Rechtsbehelfsbelehrung gives you one month to file Widerspruch (§ 73 VwVfG / residence procedure rules). Send a written objection to the office that issued the letter; immigration lawyers handle many Widerspruch cases.

Ask whether a Fiktion or temporary right to remain applies while Widerspruch is pending — this varies by case.

Filing Widerspruch

State clearly that you file Widerspruch, cite the Bescheid date and Aktenzeichen, explain factual errors (income miscalculated, wrong permit category, overlooked family tie), and attach evidence. Missing the one-month deadline usually ends your appeal rights unless exceptional rules apply.

Step 1: Note permit type, Gültig bis, and work conditions.

Step 2: Calendar renewal appointment before expiry.

Step 3: Gather listed documents; bring originals and copies to Termin.

Step 4: If Ablehnung — calendar one-month Widerspruch deadline.

Step 5: After job loss or address change — inform Ausländerbehörde promptly.

Step 6: Keep eAT card safe; report loss/theft immediately.
