What is a fristlose Kündigung?
A fristlose Kündigung (also außerordentliche Kündigung or Kündigung ohne Einhaltung einer Kündigungsfrist) terminates a contract immediately without waiting for the normal notice period. It is allowed only when continuing the relationship is unreasonable for the terminating party until the ordinary end date — typically after a serious breach.
It can come from your landlord (ending the lease) or your employer (ending your job). Tenants and employers can also issue fristlose Kündigung in rare cases, but most letters people receive are landlord-to-tenant or employer-to-employee.
Housing letter vs employment letter

Fristlose Kündigung at work

The employer must show a wichtiger Grund (important cause) that makes waiting unreasonable, such as:
- Theft, fraud, or serious dishonesty at work
- Violence or credible threats
- Gross insubordination or sabotage after warning
- Working under heavy intoxication where safety is at risk
- Serious breach of confidentiality
Minor mistakes, single lateness, or personality conflicts usually do not justify fristlose dismissal — ordinary termination with notice and warnings is required first.
Two-week rule (employment)
The employer must generally declare fristlose Kündigung within two weeks of learning the facts that justify it. Delay can make the dismissal invalid, forcing ordinary notice rules instead.
If you dispute it and Kündigungsschutz applies, you still have only three weeks from receiving the written letter to file Kündigungsschutzklage at the Arbeitsgericht — the same deadline as ordinary dismissal.
Fristlose Kündigung in rental housing
Ordinary move-out timing is covered in Wohnungskündigung. Fristlose landlord termination demands you leave without the usual three-month notice when, for example:
- Repeated or severe unpaid rent after formal warning (Mahnung)
- Serious damage to the flat or building
- Disturbance of peace — persistent noise, harassment of neighbours after warnings
- Illegal subletting or commercial use against contract
- Health or safety danger from tenant conduct
Landlord Eigenbedarf (personal use) is normally not fristlos — it uses notice periods under Eigenbedarfskündigung rules.
Warnings before fristlos (rental)
Courts usually expect a prior Abmahnung or Mahnung for curable breaches (late rent, noise). Immediate termination without warning is reserved for extreme cases — e.g. major destruction or assault. If the landlord skipped warnings for a fixable problem, the Kündigung may be void.
Written form (Schriftform)
Like ordinary Kündigung, fristlose termination must be in Schriftform — signed written letter. Email or WhatsApp alone is usually insufficient. The letter should state:
- That termination is fristlos / außerordentlich
- The factual reason (Kündigungsgrund)
- Contract and parties identified
- Date of termination (often immediate)
- Signature of the terminating party
Vague letters without clear facts are easier to challenge.
Ordinary vs fristlose — quick comparison
- Ordentliche Kündigung — notice period runs; you keep housing or job until Beendigungsdatum
- Fristlose Kündigung — ends immediately if valid; no Kündigungsfrist
- Bar — serious breach + often strict timing (two weeks at work; immediate reaction expected in housing emergencies)
- Challenge — employment: Arbeitsgericht within three weeks; rental: often civil action or Widerspruch depending on stage; after a Räumungsaufforderung court deadlines apply
If you must leave the flat immediately
Do not ignore a letter you believe is wrong — but also do not accept an illegal lockout. If the landlord changes locks without a court order, that is often unlawful. Document everything, contact a Mieterverein, and check whether a formal Räumungsaufforderung or court Räumungstitel followed.
If you genuinely owe large rent, negotiate payment or seek Wohngeld / social advice — but fristlos may still stand if formal requirements were met.
If you lose your job immediately
Register with the Agentur für Arbeit on the first day without work. Bring the Kündigung letter for Arbeitslosengeld. A disputed fristlos dismissal for misconduct can trigger Sperrzeit (blocking period) if upheld — facts in the letter matter.
Do not sign an Aufhebungsvertrag under pressure the same day without legal advice.
What to do — step by step
Step 1: Identify rental vs employment and who terminated.
Step 2: Check Schriftform, signature, and stated Kündigungsgrund.
Step 3: Compare facts to your records (rent payments, warnings, employment incidents).
Step 4: Note deadlines — three weeks for Kündigungsschutzklage; rental court dates if Räumung started.
Step 5: Contact Mieterverein, employment lawyer, or union the same week if you challenge.
Step 6: Register unemployment or arrange emergency housing if termination is upheld pending appeal.
When to get help
- Letter says fristlos but facts seem minor or old.
- No prior Mahnung/Abmahnung for curable rental breach.
- Dismissal during pregnancy, Elternzeit, or Schwerbehinderung.
- Landlord threatens lockout or removes belongings.
- Employer missed the two-week declaration window.
- You received Räumungsaufforderung after fristlose Kündigung.
