What is an Eröffnungsbeschluss?
An Eröffnungsbeschluss is the court order that opens (Eröffnung) insolvency proceedings. It comes from the Insolvenzgericht (insolvency division of the Amtsgericht) after you or a creditor filed for Verbraucherinsolvenz or standard consumer insolvency.
Until this letter, you were in the pre-opening phase — application pending, perhaps still facing Gerichtsvollzieher enforcement. From the opening date in the Beschluss, the formal insolvency estate exists and special rules apply to your assets, income, and creditors.
Receiving an Eröffnungsbeschluss is a major milestone — not the end of the process. It is the start of the court-supervised phase that can eventually lead to Restschuldbefreiung after the Wohlverhaltensperiode.
How you get here
Typical path before the Eröffnungsbeschluss arrives:
- Free Schuldnerberatung and mandatory Außergerichtliche Einigung (out-of-court settlement attempt)
- Filing an insolvency application at the correct Amtsgericht if no plan works
- Court checks whether you are zahlungsunfähig or überschuldet
- Short gap while the court prepares the opening — you may receive an Antrag acknowledgment first
- Eröffnungsbeschluss — proceedings are open (you are here)

How to read your Eröffnungsbeschluss
Every opening order should show at least:
- Amtsgericht / Insolvenzgericht — which court opened the case
- Aktenzeichen — your insolvency file number (quote this in every reply)
- Eröffnungsdatum — the legal date proceedings start
- Name of the appointed Insolvenzverwalter (if one is named — common in consumer cases)
- Whether proceedings are Regelverfahren or simplified consumer procedure
- Reference to publication in the Insolvenzbekanntmachungen (public insolvency notices)
- Deadlines for creditors to register claims — often called Frist zur Anmeldung von Forderungen
Keep the original safely. You will need the Aktenzeichen for banks, creditors, Schuldnerberatung, and the Verwalter for years.
What changes immediately after Eröffnung
From the opening date, several shifts happen at once:
- Masseschuldner rules apply — attachable assets belong to the insolvency estate unless protected by law
- Individual creditors generally cannot enforce separately against you for pre-opening claims — insolvency law takes priority
- Ongoing Gerichtsvollzieher actions on those claims should be paused or redirected — tell your counselor if enforcement continues
- You must cooperate with the court and Insolvenzverwalter — hiding assets or income is a serious offence
- New debt should be avoided except for essentials — reckless borrowing can endanger later Restschuldbefreiung
Your everyday protected minimum (pfändungsfreier Betrag) still matters for living expenses, but the Verwalter may coordinate how attachable income is paid.
The Insolvenzverwalter — what they do
The Insolvenzverwalter (insolvency administrator) is appointed by the court to manage the insolvency estate. In consumer insolvency they often supervise rather than sell everything — but their powers are real.
Typical duties:
- Collect information on your assets, income, and bank accounts
- Review creditor claims registered in the Insolvenztabelle
- Take attachable assets and coordinate distribution to creditors (if any)
- Receive attachable portions of your income during the proceeding and Wohlverhaltensperiode
- Report to the court on your cooperation
You will receive separate letters from the Verwalter — questionnaires, payment instructions, appointment dates. Respond on time and honestly. If the Eröffnungsbeschluss names a Verwalter, note their address and reference your Aktenzeichen in the subject line of every letter or email.

Gläubiger — registering claims (Forderungsanmeldung)
After Eröffnung, creditors must register their claims with the Insolvenzverwalter within the deadline stated in the Beschluss and public notice. This is the Forderungsanmeldung — registering claims for the Insolvenztabelle (schedule of debts).
As the debtor, you usually do not file claims yourself — but you should:
- Compare the list of creditors you gave Schuldnerberatung with letters you still receive
- Inform the Verwalter if a creditor is missing or the amount looks wrong
- Keep copies of all old Mahnbescheid, Vollstreckungsbescheid, and loan contracts — the Verwalter may ask for them
- Not pay individual pre-opening creditors voluntarily without advice — payments may need to go through the estate
Creditors who miss the registration deadline may lose ranking or face exclusion — that is their problem, not yours to fix. If a creditor contacts you directly, forward the matter to Schuldnerberatung or reply with your Aktenzeichen and a copy of the Eröffnungsbeschluss.
Your duties as Schuldner after opening
- Complete every Verwalter questionnaire truthfully and on time
- Report changes in address, employment, and income immediately
- Hand over attachable income as instructed — you keep protected minimum amounts
- Do not sell, gift, or hide assets without permission
- Attend court hearings if summoned
- Continue rent, utilities, and other current living costs — insolvency does not pause everyday bills
- Work with Schuldnerberatung through the Wohlverhaltensperiode toward Restschuldbefreiung
Serious breaches can lead to refusal of Restschuldbefreiung later — treat Verwalter letters with the same urgency as the Eröffnungsbeschluss itself.
Assets, income, and your bank account
Pfändungsfrei (protected) income and basic household goods generally stay with you. Non-essential assets — spare vehicles, valuable items, non-protected savings above exempt limits — may enter the estate.
A P-Konto may still be relevant before and during early proceedings. After opening, the Verwalter often instructs how salary is split between you and the estate.
Do not empty accounts or transfer money to relatives before or after Eröffnung without legal advice — reversals and criminal consequences are possible.
Enforcement and Gerichtsvollzieher after Eröffnung
Once insolvency is open, enforcement against the insolvency estate for pre-opening monetary claims is generally suspended. If a Gerichtsvollzieher still visits or a new Pfändungsbeschluss arrives for an old debt, show the Eröffnungsbeschluss and contact Schuldnerberatung the same day.
Some claims fall outside the insolvency — very new debts, certain fines, or post-opening obligations may still be enforceable separately. Your counselor identifies which letters you can set aside.
Schufa and credit after Eröffnung
Opening insolvency is reported to credit agencies including Schufa, typically as Insolvenzverfahren. The entry often appears around Eröffnung and remains for a long period — even after eventual Restschuldbefreiung the completed procedure can stay visible for years.
That is expected, not a surprise penalty. Many people already have severe negative entries from enforcement before opening. The Eröffnungsbeschluss marks the structured path forward rather than endless individual collections.
During proceedings, new credit contracts are difficult — focus on basic banking, budgeting with Schuldnerberatung, and meeting Verwalter duties.
What to do — step by step
Step 1: Read the Eröffnungsbeschluss fully — note Aktenzeichen, opening date, and Verwalter name.
Step 2: Inform Schuldnerberatung you received it — bring the letter to your next appointment.
Step 3: File the Beschluss with your insolvency documents; scan a copy to secure storage.
Step 4: Watch for Verwalter mail — respond by every deadline.
Step 5: If creditors or bailiffs contact you about old debts, send Aktenzeichen and Eröffnungsbeschluss copy.
Step 6: Plan for the Wohlverhaltensperiode — attachable income rules continue toward Restschuldbefreiung.
When to get help
- Eröffnungsbeschluss lists a hearing date or you are summoned to court
- No Insolvenzverwalter is named and you receive conflicting instructions
- Enforcement continues after you sent the opening order
- Verwalter alleges incomplete disclosure — respond only with Schuldnerberatung or lawyer
- Mixed business and private debts — procedure may differ
